Exhale — Terms of Service

1. What Exhale Is

Exhale ("we," "us," or "the Platform") is a companionship and peer-support service designed primarily for nurses and other healthcare workers. Exhale provides access to a virtual companion ("Rae"), which may be powered by artificial intelligence, a human operator, or a combination of both at any given time.

Exhale is NOT a substitute for professional mental health treatment, medical care, therapy, or psychiatric services. Exhale does not provide diagnosis, treatment, counseling, or medical advice of any kind.

By using Exhale, you acknowledge and agree that you are seeking companionship and peer support — not clinical care — and that any conversation you have through this Platform is not a substitute for seeing a licensed therapist, counselor, psychiatrist, or physician.

2. Eligibility

You must be at least 18 years old to use Exhale. By creating a session or making a payment, you represent that you meet this requirement.

3. Nature of the Service

Sessions with Rae may be conducted by an automated AI system, by a live human operator typing as Rae, or by a combination of both within the same conversation. We do not guarantee which mode is active at any given time. The identity of any human operator behind Rae will not be disclosed, and you agree not to attempt to identify, contact, or expose any individual operating the Platform outside of the Platform itself.

4. Payment and Refunds

All sessions are paid in advance through our payment processor (Stripe). Pricing for each session type is displayed at the time of booking.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE.

• Quick sessions ("Vent to a Friend"), Full Debrief sessions, and Monthly Pass payments are non-refundable once a session has begun or a billing cycle has started, regardless of how much of the session or membership period was used.
• Monthly memberships renew automatically and will be charged on each renewal date until cancelled. Cancelling a membership stops future charges but does not refund the current billing period.
• If a technical failure on our end completely prevents you from starting your paid session, contact us at support@exhalecompanion.com within 48 hours and we will, at our sole discretion, offer a rebooking for an equivalent session. This is the sole remedy available for technical issues.
• No refunds will be issued for dissatisfaction with the content, tone, or outcome of a conversation, as this is a subjective companionship service and not a guaranteed clinical or emotional outcome.

5. Crisis Situations

Exhale is not equipped to handle emergencies. If you express thoughts of suicide, self-harm, or harm to others, you will be directed to the 988 Suicide & Crisis Lifeline (call or text 988) or emergency services (911). Exhale and its operators are not responsible for monitoring, intervening in, or responding to mental health emergencies beyond providing this redirection.

If you are currently in crisis, please stop using this Platform and contact 988 or 911 immediately.

6. Prohibited Conduct

You agree not to use Exhale to discuss or plan criminal activity or harm to another person; send or request sexual or explicit content; attempt to identify the human operator(s) behind Rae; share another person's private health information in violation of HIPAA or any privacy law; or use the Platform for any unlawful purpose. We reserve the right to terminate any session or account that violates these terms, without refund.

7. Confidentiality

We treat your conversations as private. However, Exhale is not a HIPAA-covered entity and conversations are not protected by therapist-patient or doctor-patient privilege. Do not share information you would not want disclosed in the event of a legal request, data breach, or safety concern requiring escalation.

8. No Professional Relationship

Use of Exhale does not create a nurse-patient, therapist-client, or any other clinical or professional relationship between you and the operator(s) of this Platform.

9. Limitation of Liability

Exhale, its owner(s), and operators are not liable for any damages, losses, or harm arising from your use of this Platform. The Platform is provided "as is" without warranties of any kind.

10. Changes to These Terms

We may update these Terms at any time. Continued use of Exhale after changes are posted constitutes acceptance of the updated Terms.
